The Washtenaw County Board of Commissioners says it’s legally obligated to comply with the demand from the U.S. Department of Homeland Security to turn over I-9 proof of eligibility of employment documents.
In a statement released Monday evening, the Board stated, after a review by Corporation Counsel and outside legal experts, the county does not have legal grounds to challenge the I-9 portion of the subpoena. However, the demand for information related to the Washtenaw County ID program presents a more complex issue.
The Commission says it has retained a Washington D.C.-based law firm to evaluate all available legal options.
Earlier this month, DHS subpoenaed the county demanding the I-9 employment forms and ID information. The move launched a severe backlash from county officials and residents.
